1. What is Needed for a Valid DMCA Notice

If you are the copyright owner (or an authorized representative), you can submit a formal notification of copyright infringement under the DMCA (17 U.S.C. § 512(c)(3)). Your notice simply needs to be a written message sent to our compliance support desk containing the following details:

  • A Signature: A physical or digital signature of the person authorized to act on behalf of the copyright owner.
  • Identification of Your Work: A clear description of the copyrighted material you believe has been infringed. If multiple works are involved, a simple representative list is perfect.
  • Location of the Material: The exact product page URL link(s) on urbandapper.shop where the item is listed. Specific links help our team find and review the material quickly.
  • Your Contact Information: Your full legal name, physical mailing address, phone number, and an active email address where we can reach you.
  • A Good Faith Statement: A brief sentence stating that you honestly believe the use of the material is not authorized by the copyright owner, its agent, or current laws.
  • An Accuracy Declaration: A statement confirming that the information in your notice is accurate and, made under penalty of perjury, that you are the true owner or are authorized to act on the owner’s behalf.

3. Our Review Process Timeline

As soon as we receive a complete, valid notice at our desk, we process it transparently:

  • Our review team will immediately check the submitted links and documentation.
  • If the notice is verified, we will look to remove or disable access to the item within 3 business days.
  • We will keep communication open by forwarding the notice and your contact details to the designer or vendor partner who supplied the item, giving them a fair opportunity to respond.

4. A Note on Accuracy (Section 512(f))

Under Section 512(f) of the DMCA, it’s important to remember that anyone who knowingly misrepresents that a product or web link is infringing can be held responsible for damages. This includes coverage for any court costs or legal fees incurred by Urbandapper, our store owner Clay Millard Viands, or our suppliers as a result of a mistaken product removal based on inaccurate details.

5. How to File a Counter-Notification

If a product listing you supplied was taken down due to a copyright notice and you believe this happened by mistake or due to a misidentification, you have every right to file a formal Counter-Notification under Sections 512(g)(2) and (3) of the DMCA.

Please send your Counter-Notification to support@urbandapper.shop with the following info:

  • Your physical or electronic signature.
  • A clear mention of the material that was removed and the exact URL location it occupied before it was taken down.
  • A statement under penalty of perjury that you genuinely believe the material was removed or disabled as a result of a mistake or misidentification.
  • Your full name, physical mailing address, and phone number.
  • A sentence stating that you consent to the jurisdiction of the Federal District Court for the judicial district where your address is located, or if you live outside the United States, for the district of Connecticut (where Urbandapper operates), and that you will accept service of process from the original complaining party.

Once we receive a valid Counter-Notification, we will share it with the person who filed the initial claim. If the copyright owner does not file a lawsuit within 10 to 14 business days, we are legally permitted to restore your listing to our storefront.

6. Protecting Creative Integrity

Urbandapper is committed to protecting original artwork and design rights. In compliance with e-commerce safety expectations, any vendor or supplier partner found to have uploaded infringing work on more than two separate occasions will have their store permissions terminated, and their inventory will be permanently removed from urbandapper.shop.
